Welcome to Sizemotion! These terms explain the rules for using our platform. We've tried to keep this straightforward and fair.

The key points:

• ✅ Be respectful and don't abuse the service
• ⚠️ AI features are helpful but not perfect - always review AI suggestions
• 💰 Paid plans auto-renew (you can cancel anytime)
• 🔒 You own your data, we just host it
• 🤝 We're in beta together - expect some bumps

1. The Basics

What is Sizemotion?

We're a team management platform that helps you with:

• Performance reviews and 360-degree feedback
• One-on-one meeting tracking
• Team organization and career ladders
• On-call schedules and absence management
• AI-powered feedback assistance

Who Can Use It?

• You must be at least 16 years old
• You must provide accurate information when signing up
• If you're signing up for your company, you must have authority to do so
• You must comply with these terms and applicable laws

Beta Status

Important: Sizemotion is currently in beta. This means:

• 🔧 Features may change or be temporarily unavailable
• 🐛 You might encounter bugs (please report them!)
• 📝 These terms may evolve (we'll notify you of major changes)
• 🤝 We'll work with you if issues arise - we're reasonable people
• 💾 Back up important data! Beta = extra caution

2. Your Account

Account Security

• Keep your password secure
• Don't share your account with others
• Let us know immediately if your account is compromised
• You're responsible for all activity under your account

Organization Accounts

If you're an admin managing your organization's account:

• You control access for your team members
• You're responsible for your users' activity
• You should have proper authority from your organization

3. Pricing & Billing

Free Trials & Beta Pricing

We may offer free trials or special beta pricing. Trial terms will be clear when you sign up. If you don't cancel before the trial ends, you'll be charged for the plan you selected.

Paid Plans

• Billing: Monthly or annual (your choice)
• Auto-renewal: Plans renew automatically unless you cancel
• Cancellation: Cancel anytime through your account settings
• Effect: Cancellation takes effect at the end of your billing period
• Refunds: Generally no refunds for partial periods, but we'll be reasonable during beta

Price Changes

We may change prices (we'll give you 30 days notice). Changes apply at your next billing cycle. If you don't like the new price, you can cancel.

Beta Promise: We'll be extra fair about pricing during beta. Early supporters won't be penalized.

4. AI Features - READ THIS CAREFULLY

What AI Does

Our AI features help you write feedback and reviews faster by providing suggestions. When you click "AI Generate," "AI Improve," etc., we send your input to third-party AI services like:

• OpenAI (ChatGPT/GPT-4)
• Anthropic (Claude)
• Google (Gemini)
• Or self-hosted models

What You MUST Understand About AI

🚨 AI suggestions are NOT guaranteed to be accurate, appropriate, fair, or unbiased.

By using AI features, you agree that:

• You MUST review all AI content: Never blindly copy/paste AI suggestions without reading them
• You're responsible for AI-generated content: If you use AI suggestions in a review, YOU are responsible for those words, not us
• AI can make mistakes: It may produce biased, inappropriate, inaccurate, or just plain wrong content
• Don't base decisions solely on AI: AI shouldn't be the only factor in performance reviews or employment decisions
• Check for bias: AI can reflect biases from its training data - review for fairness

What We Do to Help

• Anonymize employee names before sending to AI (replaced with placeholders)
• Minimize the data we send (only what's needed)
• Use reputable AI providers with good policies
• Don't use your data to train AI models

What We're NOT Responsible For

We are NOT liable for:

• ❌ Employment decisions based on AI suggestions
• ❌ Discrimination or bias in AI-generated content
• ❌ Errors or inaccuracies in AI suggestions
• ❌ Legal claims arising from your use of AI content
• ❌ Downtime or changes to AI providers

Bottom line: AI is a helpful assistant, not a replacement for human judgment. Use it wisely.

5. Your Content & Data

You Own Your Content

All the reviews, feedback, notes, and data you create belong to YOU (or your organization). We just store and process it for you.

What We Can Do With Your Content

You give us permission to:

• Store and display your content within your organization
• Back up your content for disaster recovery
• Create anonymized, aggregated analytics (nothing that identifies you or your company)
• Use your feedback to improve the service

What You Can't Do

Don't upload content that:

• Is illegal, harmful, or discriminatory
• Violates someone's privacy or intellectual property
• Contains malware or viruses
• Harasses or abuses others

Data Backup

Important: While we perform regular backups, you should export important data regularly (especially during beta). We're not liable for data loss beyond our reasonable control.

6. Acceptable Use

Please use Sizemotion responsibly. Don't:

• 🚫 Abuse, harass, or discriminate against others
• 🚫 Try to hack, breach security, or access others' data
• 🚫 Upload malware or malicious code
• 🚫 Scrape or copy the service
• 🚫 Resell or redistribute access
• 🚫 Use it for illegal purposes
• 🚫 Overwhelm our systems (be reasonable with API usage, etc.)

During Beta: We understand you're testing things out. Accidental mistakes are fine - just don't deliberately abuse the service.

7. Intellectual Property

Our Stuff

Sizemotion, our logo, the platform design, and features are ours (or our licensors'). You can't copy, modify, or redistribute them.

Your License to Use

We give you permission to use Sizemotion for your business purposes. This permission is:

• Limited to your organization's internal use
• Non-transferable (you can't sell or give away access)
• Revocable if you violate these terms

8. Service Availability

Beta Reality Check

Honest disclaimer: We're in beta. That means:

• The service might go down sometimes (we'll fix it ASAP)
• Features might change or temporarily break
• We might need to do maintenance (we'll try to warn you)
• Performance might vary as we scale

We're working hard to make Sizemotion reliable, but we can't promise 100% uptime during beta (or ever - no one can!).

Support

We offer email support. Response times depend on your plan, but during beta, we're pretty responsive because we want to hear your feedback!

9. Privacy

How we handle your data is explained in our Privacy Policy. Please read it - it's actually pretty straightforward.

Key points:

• We don't sell your data
• We use third-party services (AI, hosting, payments)
• We keep data secure
• You can request/delete your data

10. Termination

You Can Leave Anytime

Cancel your account through settings or email us. You keep access until the end of your billing period.

We Can End It Too

We can suspend or terminate your account if you:

• Violate these terms
• Don't pay your bills
• Abuse the service or other users
• Pose security or legal risks

During Beta: We'll be more lenient and try to work things out before terminating accounts.

After Termination

• Export your data before canceling (you'll have time)
• We keep backups for 90 days, then delete everything
• Some data may be retained for legal/accounting requirements

11. Disclaimers (The Legal Stuff)

THE SERVICE IS PROVIDED "AS IS" - especially during beta. We don't guarantee:

• Perfect uptime or performance
• Bug-free operation
• AI accuracy or appropriateness
• That it will meet all your expectations

What this means in plain English: We're building a great product and working hard to make it reliable, but we can't promise perfection, especially during beta. Use it at your own risk.

12. Liability Limits

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability is capped at what you paid us in the last 12 months (or €100, whichever is more)
• We're not liable for indirect damages (lost profits, lost data, etc.)
• This applies to AI-generated content, data loss, security breaches, or service issues

What this means: If something goes wrong, we'll try to make it right, but our financial responsibility is limited. That's why you should back up important data and review AI suggestions carefully.

Beta Note: We'll work with early users on a case-by-case basis if significant issues arise.

13. Changes to These Terms

We may update these terms as we:

• Add features
• Refine policies based on feedback
• Need to comply with new laws
• Exit beta and launch officially

When we make changes:

• We'll update the "Last Updated" date
• We'll email you for significant changes
• Changes take effect when posted (or 30 days for material changes)
• Continued use means you accept the changes

During Beta: Expect more frequent updates. We're iterating based on your feedback!

14. Legal Stuff

Governing Law

These terms are governed by the laws of the Netherlands. Any disputes would be handled in Dutch courts.

Miscellaneous Legal Bits

• Entire Agreement: These terms + our Privacy Policy = our complete agreement
• Severability: If part of these terms is invalid, the rest still applies
• No Waiver: Just because we don't enforce something once doesn't mean we won't later
• Assignment: You can't transfer these terms; we can (e.g., if we get acquired)
